The Health Lottery operates on behalf of The Health Lottery Foundation, PO BOX 8109, Daventry, NN11 1JA. Promoter: Delva Patman.
1. INTRODUCTION
1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for The Big Win society lottery draws (“the Lottery”) which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of The Health Lottery Foundation (“the CIC”).
1.2 The correspondence address is The Health Lottery, Northern & Shell Building, 10 Lower Thames Street, London EC3R 6EN.
1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk ) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.
1.4 The Health Lottery Scheme operates under the Gambling Act 2005, (“The Act”).
1.5 The Health Lottery Foundation is licensed by the Gambling Commission to run a society lottery for the benefit of health-related causes within England, Scotland and Wales.
1.6 20% of the proceeds of each Lottery shall go towards health-related Good Causes.
1.7 All entries into and participation in the Lottery are strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.
1.8 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules, and THL will provide a copy by post if requested to do so on receipt of a stamped addressed envelope at the address in clause 1.2 above. T&Cs booklets and copies of the shortened form of the T&Cs and Game Rules (the Player’s Guide) can be obtained from a Health Lottery Participating Retailer.
1.9 If and when changes are made to the T&Cs, THL will use its database of Players that have registered online to notify all those Players for whom it has email details. THL will also distribute a revised version of its T&Cs to all Participating Retailers.
2. DEFINITIONS
Any words within these T&Cs which start with a capital letter shall have the following meanings:
(a) “The Big Win Lottery Game” means The Health Lottery product consisting of lottery draws which are normally held on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays (such frequency may be subject to change) and cost £1 per lottery entry. Each £1 entry into either a Wednesday or Saturday draw also entitles the player to one automatic free entry into a Free Prize Draw..
(b) “Quick Pick Game” means the Health Lottery product offered by THL consisting of lottery draws which are normally held on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays (such frequency may be subject to change) and cost £1 per lottery entry and lottery numbers are selected by the lottery system using a random number generator. Each £1 entry into either a Wednesday or Saturday draw also entitles the player to one automatic free entry into a Free Prize Draw.
(c) “Bonus Ball” means the number drawn in addition to the 5 regular numbers in the draw for The Big Win Lottery Game. This may also be referred to as the “Bonus Number” in marketing materials referring to The Big Win Lottery Game.
(d) “Claim Form” means a form provided by THL by mail or email to Players claiming a Prize of more than £50 in accordance with the THL postal claim procedure.
(e) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, the CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.
(f) “Fixed Prize” means a prize category below the Jackpot Prize where the winners will receive a set amount not shared with other players subject to the same limitations in exceptional circumstances found at sections 6.18 of these T&Cs. These prize categories are: a free £1 ticket, £5, £10, £50, £300 and £10,000.
(g) “Game Rules” means the rules which are applicable to playing the draw-based lottery game (The Big Win Lottery Game) and which are published on THL’s website.
(h) “Good Causes” means the promotion of health health-related causes in communities and groups across England, Scotland and Wales.
(i) “Free Prize Draw” means the free draw which is normally conducted every Wednesday and Saturday following the main £1 Big Win lottery draws. On these days, a new set of lottery numbers are selected by the lottery ball machine to determine the winning numbers for these free prize draws.
(j) “Free Prize Draw Numbers” means the 5 lottery numbers selected or chosen for the Player for a Wednesday or Saturday Big Win lottery draw, which are also automatically entered into the Free Prize Draws on these days.
(k) “Free Prize Draw Prize” means the cash amount offered by THL in its free draws usually held each Wednesday and Saturday. This is currently one prize each draw of at least £100,000. THL reserves the right to change the prize amount at its absolute discretion by providing advance notice on its Website. In the event that there are multiple match 5 winners, the prize will be evenly divided between all those matching 5 numbers.
(l) “Jackpot” or “Jackpot Prize” means the top prize in any Big Win Lottery Game Lottery Draw.
(m) “Lottery Draw” or “Draw” means the weekly lottery draws conducted by THL every Tuesday, Wednesday, Thursday, Friday and Saturday (such frequency may be subject to change) for The Big Win Lottery Game. Sales will be closed for these draws at 19.45 on each draw day. THL reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday, or any other day deemed unsuitable for holding a Draw by Health Lottery Management, in its discretion.
(n) “Lottery Ticket” or “Ticket” means the Ticket which is purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player (or in the case of a Quick Pick Ticket the numbers selected randomly) for entry into the Lottery and which may contain more than one line of play. Where a player has purchased a Ticket for a Wednesday or Saturday draw, their chosen or selected lottery numbers will also be entered into that day’s free prize draw;
(o) “Participating Retailer” means a retailer or store that has agreed to sell The Health Lottery’s Big Win Tickets on behalf of THL and the CICs.
(p) “Play” means any individual selection of 5 numbers entered into the Lottery.
(q) “Player” means an eligible person who purchases a Lottery Ticket in accordance with these T&Cs; and
(r) “Player’s Guide” means the shortened Game Rules and Terms and Conditions printed by THL for use at retail locations.
(s) “Prize” means the prize monies, non-cash Prizes or Free Ticket that may be won in the course of the Lottery draw or Free Prize Draw in accordance with these T&Cs and any other rules of the Lottery.
(t) “Prize Ticket Promotion” means any promotion that the Health Lottery may run from time to time offering the chance to win a ticket as a Prize to Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion. A ticket prize can be entered into a draw of the players choice (up to 5 weeks in advance for online players). If a player chooses to play their ticket in a Wednesday or Saturday draw, they’re also automatically entered into the Free Prize Draw which also takes place on these days. The opening and closing dates for these promotions will be stated clearly on the Health Lottery Website under the ‘Offers’ tab and in print advertisements for the promotion.
(u) “Prize Ticket” means a single entry for Play into a Big Win Lottery Draw of the players choice and, if used for a Wednesday or Saturday draw, free automatic entry into a Free Prize Draw, issued as a prize for Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion, whether for the same or another participating CIC at times when THL is offering a Prize Ticket Promotion. Prize Tickets must be used within 180 days of being issued after which time they will expire.
(v) “Prize Capping” means the process that may be applied, if required by The Health Lottery to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw of The Big Win Lottery Game exceeds £250,000.
(w) “Quick Pick” means a line of play where all numbers have been selected at random by the lottery system using a random number generator.
(x) “Winning Number” or “Regular Number” means the 5 numbers drawn in The Big Win Lottery Game before any Bonus Ball is drawn.
(y) “Ticket” means a paid for entry into The Big Win Lottery Game. This is defined in (n) above.
3. CONDITIONS OF ENTRY
3.1 To enter the Lottery and to be eligible to win a Prize, Players:
(a) Must be 18 years of age or over to play online or in retail, and
(b) Must comply with these T&Cs and any other rules of the Lottery notified by THL.
3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the Lottery.
3.3 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude for a period of 6 months to 5 years. Once excluded, Players will not be able to delete their account as a record of their exclusion must be kept.
3.4 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.
3.5 In purchasing a Ticket, Players acknowledge and agree that 20% of the Ticket price will go towards Good Causes.
3.6 By personally accepting the Prize from THL, Players warrant that they:
(a) Are not a director or an employee of THL, the CICs, or a key IT contractor or supplier claiming a prize on their own behalf. A director or an employee of THL may however claim a prize on behalf of THL;
(b) Are not a spouse or dependent of any person described in 3.6(a); and
(c) Are eligible to win a Prize under clause 3.1; and
(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.
3.7 THL will have discretion as to whether to accept any entry to its Big Win Lottery Draws and Free Prize Draws and pay out any Prizes. Its decision in the matter may be challenged via the complaints procedure (See point 10.0 for details).
3.8 THL will rely on its own technical logs and records when determining whether a Player is eligible to receive a Prize.
3.9 Special Offer Abuse: If we reasonably suspect that you may deceitfully take (or attempt to take) unfair advantage of, or exploit or manipulate (or attempt to exploit or manipulate), any of the promotions, bonuses or special offers that we may offer on the Site or across our network from time to time (examples of which include: (i) opening multiple indistinguishable accounts to obtain a welcome bonus several times on this Site; (ii) only depositing during promotional periods in order to receive a bonus and not depositing at any other times; (iii) opening multiple accounts on the Site or across our network; (iv) where we have reasonable suspicion as to the truthfulness of your identity; (v) repeatedly depositing, cashing out and redepositing purely to gain a deposit related bonus, then we will deem this to be “Special Offer Abuse”. In such circumstances, we may deny, withhold or withdraw from you any bonus, offer or promotion, either temporarily or permanently, or close your account.
3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery’s Big Win game and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the THL Website.
4. HOW TO ENTER THE BIG WIN LOTTERY & FREE PRIZE DRAW
4.1 Players enter the Big Win Lottery Draw either by purchasing a paper Ticket from a retailer authorised by THL or by using the Website/mobile app to purchase an online Ticket. Tickets will normally cost £1 per entry into a Tuesday, Wednesday, Thursday, Friday and Saturday draw.
4.2 Participating Retailers may require proof of age or other identification to be shown before the Ticket will be sold. THL reserves the right to introduce new channels.
4.3 For The Big Win Lottery Game, the Player must choose five different lottery numbers, each of which must be between 1 and 50 inclusive or may prefer to be allocated five different numbers in that range (a “Quick Pick”).
4.4 For The Big Win Lottery Game the Player may choose to activate a Health Lottery Big Win Playcard (the “Playcard”) with their chosen five number selections for any play. Participating Retailers can activate a Playcard, or Players may activate the Playcard by phoning Customer Support or using the Website. The activation of a Playcard will result in one or more selections of five numbers (up to a maximum of ten) being recorded on The Health Lottery account record designated by the unique number on the Playcard in question.
4.5 Following activation, a Playcard may be used to purchase Tickets for future Draws of The Big Win Lottery Game.
4.6 When available, a play-slip or a Player’s Guide with a detachable single use Playcard may also be used to purchase Tickets.
4.7 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket. Players may choose to purchase a Ticket which enters the Player into the Lottery and automatic entry into the appropriate Free Prize Draw for up to five weeks in advance.
4.8 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are those requested.
4.9 For each lottery line purchased for any Wednesday or Saturday draw, the player’s same lottery numbers will also be automatically entered into a Free Prize Draw on the same evening, following The Big Win draw.
4.10 Online Players with an active Direct Debit (“Subscription Players”) will automatically be entered into the appropriate Free Prize Draw at no additional cost. This information will be included in a confirmation email to the Player.
4.11 Cancellations are allowed only under exceptional circumstances. Any cancellation or reversal will need to be completed at the same location and on the same terminal as the original transaction. THL will allow cancellations and reversals for both a Ticket sale and a pay-out. In e-Pay and Payzone Retailers, also in Participating Retailers using their own EPOS system to sell Tickets there will be a 30-minute window after which a reversal and cancellation cannot be performed at the terminal. PayPoint Retailers will only allow a cancellation within 10 minutes of the relevant transaction provided that no other transactions have been made in the interim.
4.12 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.
4.13 A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a Ticket in advance of a Draw that is subject to a change in these Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by THL on the website. The Player must contact THL in writing at The Health Lottery, Northern & Shell Building, 10 Lower Thames Street, London EC3R 6EN, including enclosing the original Ticket, name, address, and the bank details to which the refund should be credited. This communication and Ticket must be received by THL at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2. Online Players must notify THL by email using their registered email address within the same 72-hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their Ticket will be withdrawn from the applicable Draw and will not be eligible for any Prizes.
4.14 The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition. For Players having participated in the Draw by purchasing a Ticket from a Retailer, the Ticket is sole evidence of entry into the Draw and must be in the possession of the Player to enable them to claim a Prize. The Playcard or play-slip cannot be used to claim a Prize or be relied upon as evidence of entry into a Draw.
4.15 Subject always to clause 9.2, THL accepts no responsibility for lost, stolen, damaged or defaced Tickets.
5. PLAYING THE BIG WIN LOTTERY ONLINE
5.1 Online Players of The Big Win Lottery are required to provide THL with their name, date of birth, address, contact details and bank or payment card details before an online registration will be processed. In order to play online Players must have a GB registered debit card registered at a GB address. Identity checks will be carried out to confirm that the Player is at least 18 years old, and this will leave a soft footprint on the Player’s credit file for 12 months. In addition, as part of its ongoing commitment to protecting players from the risk of gambling harm, THL will undertake enhanced due diligence to determine whether a player is spending within their means. THL monitors both financial and behavioural triggers and affordability checks will be carried out on those exhibiting potential signs of harm. These checks will also leave a soft footprint on the Player’s credit file.
5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. No more than £500 may be deposited in the e-wallet in a single transaction. Players can make payments by debit card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.
5.3 Online Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.
5.4 No online Player may purchase more than £80 of Tickets for any single Lottery Draw. A Player purchasing Tickets on behalf of a syndicate may not purchase more than £80 of Tickets for any single Lottery Draw per member of the syndicate.
5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.
5.6 THL may impose such cooling-off periods on the use of deposited monies as it considers appropriate and will notify the same to Players before the deposit is accepted.
5.7 THL may suspend or terminate a Player’s online account at any time if we believe that there has been a breach of these terms and conditions. Players have the right to challenge this decision under the Company’s complaint procedure. Upon the termination of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 14 working days.
5.8 Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should click on the unsubscribe link shown on all Health Lottery e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Customer Support on 0330 390 2289. Calls to The Health Lottery Helpline will be charged at local call rate. Players may also update their marketing preferences via their online account.
5.9 Online entries are final and cannot be cancelled, reversed or refunded once completed.
5.10 In addition to these T&Cs, Health Lottery online play is subject to the Terms and Conditions for Playing the Health Lottery’s Big Win Draw Game and Free Prize Draw via the Internet and by Direct Debit published on the Website.
6. THE BIG WIN LOTTERY DRAW AND PRIZES
6.1 For The Big Win Lottery Game, the Lottery Draws will take place on a weekly basis on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays. THL also reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday.
6.2 For the Free Prize Draws, these will usually take place on a Wednesday and Saturday. THL also reserves the right to hold a Draw on an alternative day should the Draw occur on a Bank Holiday.
6.3 The results of any Lottery will be published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning Ticket which has the number(s) recorded at the Draw itself by THL. Online Players will be notified automatically to their registered e-mail address if they have won a Prize.
6.4 In the Lottery Draw, five numbers will be drawn at random by an approved ball machine from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be drawn after all five Winning Numbers have been drawn.
6.5 Only one Prize may be claimed in respect of each entry made to the Lottery Draw.
6.6 Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows for The Big Win Lottery Game whose draws are held on a Tuesday, Wednesday, Thursday, Friday or a Saturday:
- If one Winning number and the bonus ball is matched on a Player’s Ticket, the Player will win one free ticket*
- If two Winning Numbers are matched on a Player’s Ticket, the Player will win one free ticket*
– If two Winning Numbers and the Bonus Ball are matched on the Player’s Ticket, the Player will win one Prize of £5.
– If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £10.
– If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.
– If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £300.
– If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.
– If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win a Prize of £25,000. If there are multiple match 5 winners, the Prize will be divided by the number of winners. For example, if there are two players, each with a ticket matching all 5 numbers, each will win £12,500. Prizes will be rounded down to the nearest pound if required.
* A ‘free ticket’ in this instance can be a Quick Pick ticket i.e. the lottery numbers will be selected at random by the lottery system using a random number generator or Players can choose their own number selection. Players can also choose which draw they would like to enter using their free ticket. The free ticket must be used within 180 days of receipt after which it will expire.
6.7 When a ‘free ticket’ is awarded as a prize, the winner may select in which draw the ticket is used. If they elect to use it on a Wednesday or Saturday draw, they will also receive an automatic free entry into that day’s Free Prize Draw.
6.8 All ‘free tickets’ are fully paid for by THL (ELM).
6.9 Players who win a Prize Ticket or a cash Prize of up to £50 inclusive with a paper Ticket in The Big Win Lottery Game may collect their Prize from any Participating Retailer which sells Tickets for the Lottery Draw. Players who win a Prize in excess of £50 with a paper Ticket must contact THL on 0330 390 2289 or by email at help@healthlottery.co.uk in order to claim their Prize. In instances where a retail player is required to claim their Prize via our Helpline or website, and the Prize includes a ‘free ticket’, a physical Quick Pick ticket will be dispatched to the Player. Free tickets can be used in any draw but, if not used, will expire in 180 days from receipt of the ticket.
6.10 Players who accumulate multiple Prizes of £10 or £20 on the same Ticket must also contact THL to claim their Prize if the total amount accumulated exceeds £50. Calls to The Health Lottery Helpline will be charged at local call rate. THL will only pay out cash Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay cash Prizes in excess of £50 by means of any new payment method that becomes available in the future.
6.11 Players are responsible for ensuring that the correct Prize is paid by the Retailer for a match Bonus Ball win, match 2 balls win, match 2 balls plus Bonus Ball win, match 3 balls win, match 3 balls plus bonus ball win or match 4 at the time the Ticket is validated, or any other day deemed unsuitable for holding a Draw by Health Lottery Management, in its discretion.
6.12 Free Prize Draw Prizes can be claimed up to 180 days after the Draw. Players must contact THL on 0330 390 2289 in order to claim their prize. Calls to The Health Lottery Helpline will be charged at local call rate.
6.13 No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.
6.14 No Prize will be paid on a Ticket that fails THL’s validation process.
6.15 Online players may collect their Prize(s) of up to £2,000 in the Lottery Draw through their Health Lottery online account. Other Prizes for higher amounts must be claimed by contacting THL on 0330 3902289. Calls to The Health Lottery Helpline will be charged at local call rate.
6.16 Online Players who win a Prize or a combination of Prizes in excess of £2,000 in the Lottery Draw must contact THL on 0330 3902289 in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.
6.17 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £250,000, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories in proportion so as to bring the total Prize pay-out to a minimum of £250,000.
6.18 The Prize Pool for each weeks Lottery is calculated once the eligible numbers have been entered into the system. All prizes on the Health Lottery’s Big Win draws will be paid in full unless Prize Capping is required.
6.19 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.
6.20 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.
6.21 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.
6.22 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen working days of receiving the Player’s identification documents but will not be liable for prize payments that are received beyond the quoted timescale. Prizes for the Health Lottery’s Big Win Game must be claimed no later than 18.00 hours on the 180th day following the day of the Draw. Any Prize not claimed within this period will be forfeited. If any Prize is claimed by post, THL must receive the Ticket and Claim Form at the address shown on the Claim Form within this period.
6.23 Each winning Player is responsible for paying any and all taxes on any Prize won.
6.24 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their consent.
7. SELF EXCLUSION
7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.
7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.
7.3 At the end of the Exclusion Term, the player’s account will remain suspended and THL will continue to make no contact with the Player. If a self-excluded Player wishes to return to gambling at the end of the selected term, they must call Customer Support on 0330 3902289 (a local rate call) or email help@healthlottery.co.uk . They will then be required to undertake an interview with our Safer Gambling Team to discuss steps that will be taken to prevent future gambling harm. All returning players will undergo a 24 hour cooling off period during which time they will be unable to access their account. In addition, once the account is active again, they will be monitored by the Safer Gambling Team for at least 3 months. Returning players should also note that if they are unable to provide satisfactory evidence that they are in control of their play, they will be prevented from accessing our games.
7.4 The Player may choose to enter another Exclusion Term at any time.
7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.
7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Customer Support or emails unsubscribe@healthlottery.co.uk. A Player may also use the unsubscribe link at the bottom of any marketing email to stop any further marketing communications.
7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or by sending a stamped addressed envelope to the address in clause 1.2 above. Alternatively, information is available from www.gamcare.org.uk.
7.8 Players who self-exclude or unsubscribe from marketing should be aware that at the time of opting out, a marketing email or emails may already be scheduled to be sent. As such we may be unable to prevent this from happening. We endeavour to cease all marketing within 24 hours from the point of self-exclusion.
7.9 If a player has an active self-exclusion, The Health Lottery shall not be responsible for players circumventing their exclusion by purchasing Big Win lottery tickets at a participating retail store. In such instances, players should be advised that in the event that they subsequently win a prize that is too large to claim in store, at the point when they contact Customer Support for a claim form, they will be informed that they are not eligible for a prize and their stake money will be refunded.
8. LIMITATION OF THE HEALTH LOTTERY’S LIABILITY & RESERVATION OF RIGHTS
8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:
(a) For death or personal injury resulting from THL’s negligence; or
(b) For fraudulent misrepresentation; or
(c) For liability that cannot be excluded or limited by law.
8.2 Subject always to clause 8.1 neither THL nor the CIC shall be liable to a Player for any loss or damage suffered by a Player arising from:
(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.
(b) Retailer error or incorrect or misuse of retailer terminal (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize).
(c) Any event which is beyond THL’s or the CIC’s reasonable control.
And in addition;
(d) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and
(e) All warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.
8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:
(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;
(b) Any special or indirect or consequential losses; or
(c) Any loss of goodwill or reputation.
8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live transmission will be uninterrupted, timely and / or error-free.
8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.
8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.
8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.
8.8 Online Health Lottery players are responsible for all play on their account; for keeping their login credentials secure, and for taking all necessary steps to ensure that their device/s cannot be accessed by any third-party when they are logged in. The Health Lottery will not be held responsible for any unauthorised game play and subsequent losses due to the account holder’s negligence in this regard.
9. LIABILITY OF PLAYERS
9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.

11. DISPUTE RESOLUTION
If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator for further investigation and review. This independent adjudicator, namely the Independent Betting Adjudication Service (IBAS), is specialised in the resolution of gaming disputes.

12. INTELLECTUAL PROPERTY
All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.
13. DATA PROTECTION
All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.
14. GOVERNING LAW
These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.
15. INSOLVENCY

These Game Rules & Terms and Conditions are in addition to, and must be read in conjunction with, The Health Lottery’s Big Win Terms and Conditions and Game Rules.
1. The Promotion
Following The Big Win lottery game draw on every Wednesday and Saturday, a second draw will be carried out to select a new set of 5 numbers. These shall be the winning numbers for the “Free Prize Draw”. All players who have purchased tickets for The Big Win lottery draw on a Wednesday or Saturday will automatically be entered into the Free Prize Draw at no cost. All players matching 5 numbers in this second draw will qualify for a prize and there are no lower tier prizes associated with matching any other numbers.
The prize for matching 5 main numbers in the Free Prize Draws will be a minimum of £100,000 cash (one hundred thousand pounds sterling) (see 6.1). The winner has 180 days to claim so retail players should make sure they keep their tickets safe. 2. Promotion Date
A Free Prize Draw will take place following the main £1.00 Big Win Draw on each Wednesday and Saturday.
3. Method of Play
3.1 Each £1 entry into The Big Win lottery draw on a Wednesday or Saturday will give players an additional automatic entry into the Free Prize Draw. No additional purchase is required. For the avoidance of doubt, this includes retail players, online players and Direct Debit customers who have entries into the main lottery draw on either of these days.
3.2 Eligible entrants into the Free Prize Draw will not be required to choose new lottery numbers for the Free Prize Draw and will not automatically be allocated new numbers. All of the same lottery numbers that are entered into The Big Win draw on either a Wednesday or Saturday will also be entered into the appropriate Free Prize Draw.

4. Winning Selection

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for the All Or Nothing lottery draw game (the Lottery) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf The Health Lottery Foundation (“the CIC”).

1.4 The Health Lottery Scheme operates under the Gambling Act 2005, (“The Act”).
1.5 The Health Lottery Foundation is licensed by the Gambling Commission to run a society lottery for the benefit of health-related causes within England, Scotland and Wales.
1.6 20% of the proceeds of each Lottery shall go towards health-related Good Causes.
1.7 All entries into and participation in the Lottery are strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.
1.8 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website and THL will provide a copy by post if requested to do so on receipt of a stamped addressed envelope at the address in clause 1.2 above.
1.9 If and when changes are made to the T&Cs, THL will use its database of Players that have registered online to notify all those Players for whom it has email details.
2. DEFINITIONS
Any words within these T&Cs which start with a capital letter shall have the following meanings:
(a) “All Or Nothing Game” means The Heath Lottery product consisting of lottery draws which are normally held on Tuesdays, and Fridays (such frequency may be subject to change) and cost £1 per lottery entry. Players select 12 numbers from 24 for the chance to win a prize.
(b) “Quick Pick” means the process by which lottery numbers are selected by the lottery system using a random number generator.
(c) “Claim Form” means a form provided by THL by mail or email to Players claiming a single Prize or combination of Prizes totalling more than £250 in accordance with the THL postal claim procedure. Completed forms must be accompanied by proof of ID before a prize is paid out. Acceptable ID includes but is not limited to a valid passport, UK driving licence and recent utility bill.
(d) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.
(e) “Fixed Prize” means a prize category where the winners will receive a set amount not shared with other players subject to the same limitations in exceptional circumstances found at sections 6.11 of these T&Cs. For the All Or Nothing game, with the exception of match 12 and match zero jackpot winners, prize categories are fixed prizes. Jackpot wins however are pari-mutuel meaning that the prize is split equally between all winners in those two prize tiers.
(f) “Game Rules” means the rules which are applicable to playing the draw-based lottery game (All Or Nothing Lottery Game) and which are published on THL’s website.
(g) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.
(h) “Jackpot” or “Jackpot Prize” means the top prizes in any All Or Nothing Lottery Game Lottery Draw which is won by matching either none or all 12 Winning Numbers.
(i) “Lottery Draw” or “Draw” means the weekly lottery draws conducted by THL every Tuesday and Friday (such frequency may be subject to change) for the All Or Nothing Lottery Game. Sales will be closed for these draws at 19.00pm on each draw day. THL reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday, or any other day deemed unsuitable for holding a Draw by Health Lottery Management, in its discretion.
(j) “Lottery Ticket” or “Ticket” means the Ticket or receipt issued a result of a purchase by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player (or in the case of a Quick Pick Ticket the numbers selected randomly) for entry into the Lottery and which may contain more than one line of play.
(k) “Play” means any individual selection of 12 numbers entered into the Lottery.
(l) “Player” means an eligible person who purchases a Lottery Ticket in accordance with these T&Cs.
(m) “Prize” means the prize monies that may be won in the course of the Lottery draw in accordance with these T&Cs and any other rules of the Lottery.
(n) “Prize Ticket Promotion” means any promotion that The Health Lottery may run from time to time offering the chance to win a ticket as a Prize to Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion. A ticket prize can be entered into a draw of the players choice (up to 5 weeks in advance). The opening and closing dates for these promotions will be stated clearly on the Health Lottery Website under the ‘Offers’ tab and in print advertisements for the promotion.
(o) “Prize Ticket” means a single entry for Play into a Lottery Draw of the players choice issued as a prize for Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion, whether for the same or another participating CIC at times when THL is offering a Prize Ticket Promotion. Prize Tickets must be used within 180 days of being issued after which time they will expire.
(p) “Prize Capping” means the process that may be applied, if required by The Health Lottery to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw of the All Or Nothing Lottery Game exceeds twice the total value of sales for that draw.
(q) “Winning Numbers” means the 12 winning numbers drawn in the All Or Nothing Lottery Game via the company’s random number generator.
3. CONDITIONS OF ENTRY
3.1 To enter the Lottery and to be eligible to win a Prize, Players:
(a) Must be 18 years of age or over and a resident of Great Britain to play, and
(b) Must comply with these T&Cs and any other rules of the Lottery notified by THL.
3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the Lottery.
3.3 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude for a period of 6 months to 5 years. Once excluded, Players will not be able to delete their account as a record of their exclusion must be kept.
3.4 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.
3.5 In purchasing an online Ticket, Players acknowledge and agree that 20% of the Ticket price will go towards Good Causes.
3.6 By personally accepting the Prize from THL, Players warrant that they:
(a) Are not a director or an employee of THL, the CIC or a key IT contractor or supplier claiming a prize on their own behalf. A director or an employee of THL may however claim a prize on behalf of THL;
(b) Are not a spouse or dependent of any person described in 3.6(a); and
(c) Are eligible to win a Prize under clause 3.1; and
(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.
3.7 THL will have discretion as to whether to accept any entry to its All Or Nothing Lottery Draws and pay out any Prizes. Its decision in the matter may be challenged via the complaints procedure (See point 10.0 for details).
3.8 THL will rely on its own technical logs and records when determining whether a Player is eligible to receive a Prize.
3.9 Special Offer Abuse: If we reasonably suspect that you may deceitfully take (or attempt to take) unfair advantage of, or exploit or manipulate (or attempt to exploit or manipulate), any of the promotions, bonuses or special offers that we may offer on the Site or across our network from time to time (examples of which include: (i) opening multiple indistinguishable accounts to obtain a welcome bonus several times on this Site; (ii) only depositing during promotional periods in order to receive a bonus and not depositing at any other times; (iii) opening multiple accounts on the Site or across our network; (iv) where we have reasonable suspicion as to the truthfulness of your identity; (v) repeatedly depositing, cashing out and redepositing purely to gain a deposit related bonus, then we will deem this to be “Special Offer Abuse”. In such circumstances, we may deny, withhold or withdraw from you any bonus, offer or promotion, either temporarily or permanently, or close your account.
3.11 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the THL Website.
4. HOW TO ENTER THE LOTTERY
4.1 Players enter the Lottery Draw either by using the Website/mobile app to purchase an online Ticket. Tickets will normally cost £1 per entry into a draw which will usually take place every Tuesday and Friday.
4.2 THL reserves the right to introduce new channels for entry into an All Or Nothing Lottery Game draw.
4.3 For the All Or Nothing Lottery Game, the Player must choose 12 different lottery numbers, each of which must be between 1 and 24 inclusive or may prefer to be allocated 12 random numbers in that range (a “Quick Pick”).
4.4 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket.
4.5 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are those requested.
4.6 Once a payment transaction has been completed, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.
4.7 A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a Ticket in advance of a Draw that is subject to a change in these Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by THL on the website. The Player must contact THL by email at help@healthlottery.co.uk or in writing at The Health Lottery, Northern & Shell Building, 10 Lower Thames Street, London EC3R 6EN, including name, address, username and the bank details to which the refund should be credited. This communication must be received by THL at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2. Online Players must notify THL by email using their registered email address within the same 72-hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their Ticket will be withdrawn from the applicable Draw and will not be eligible for any Prizes.
5. PLAYING THE LOTTERY (ONLINE ONLY)
5.1 Players of the Lottery are required to provide THL with their name, date of birth, address, contact details, email address and bank or payment card details before an online registration will be processed. In order to play Players must have a GB registered debit card registered at a GB address. The use of credit cards to pay for entry is strictly forbidden. Identity checks will be carried out to confirm that the Player is at least 18 years-old and this will leave a soft footprint on the Player’s credit file for 12 months.
5.2 Registered Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. No more than £2,000 may be deposited in the e-wallet in a single transaction. Players can make payments by debit card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CIC. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.
5.3 Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.
5.4 No Player may purchase more than £80 of Tickets for any single Lottery Draw. A Player purchasing Tickets on behalf of a syndicate may not purchase more than £80 of Tickets for any single Lottery Draw per member of the syndicate.
5.5 No Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.
5.6 THL may impose such cooling-off periods on the use of deposited monies as it considers appropriate and will notify the same to Players before the deposit is accepted.
5.7 THL may suspend or terminate a Player’s online account at any time if we believe that there has been a breach of these terms and conditions. Players have the right to challenge this decision under the Company’s complaint procedure. Upon the termination of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 14 working days.
5.8 Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should click on the unsubscribe link shown on all Health Lottery e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Customer Support on 0330 390 2289. Calls to The Health Lottery Helpline will be charged at local call rate. Players may also update their marketing preferences via their online account..
5.9 In addition to these T&Cs, Health Lottery online play is subject to the ‘Terms and Conditions for Playing Health Lottery Draw Games via the Internet and by Direct Debit’ published on the Website.
6. ALL OR NOTHING LOTTERY DRAW AND PRIZES
6.1 Lottery Draws will take place on a weekly basis on Tuesdays and Fridays. THL also reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday.
6.2 The results of any Lottery will be published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning Ticket which has the number(s) recorded at the Draw itself by THL. Players will be notified automatically to their registered e-mail address if they have won a Prize.
6.3 In the Lottery Draw, 12 numbers will be drawn at random by an approved ball machine from the range between 1 and 24 inclusive (the “Winning Numbers”).
6.4 Only one Prize may be claimed in respect of each entry made to the Lottery Draw.
6.5 Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows for the All Or Nothing Lottery Game whose draws are held on a Tuesday and Friday:
- If zero Winning Numbers are matched on a Player’s Ticket, the Player will win £25,000.
- If one Winning Number is matched on a Player’s Ticket, the Player will win £250.
- If two Winning Number is matched on a Player’s Ticket, the Player will win £25.
- If three Winning Numbers are matched on a Player’s Ticket, the Player will win £2.50.
- If four Winning Numbers are matched on a Player’s Ticket, the Player will win £1.00.
- If five, six or seven Winning Numbers are matched on a Player’s Ticket, the Player will win nothing.
- If eight Winning Numbers are matched on a Player’s Ticket, the Player will win £1.00.
- If nine Winning Numbers are matched on a Player’s Ticket, the Player will win £2.50.
- If ten Winning Numbers are matched on a Player’s Ticket, the Player will win £25.
- If eleven Winning Numbers are matched on a Player’s Ticket, the Player will win £250.
- If twelve Winning Numbers are matched on a Player’s Ticket, the Player will win £25,000.
6.6 Players who accumulate multiple Prizes on the same Ticket (for example a player who has purchased multiple lines in a single draw that each win a prize) must also contact THL to claim their Prize if the total amount accumulated exceeds £250. Calls to The Health Lottery Helpline will be charged at local call rate. THL will only pay out cash Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay cash Prizes in excess of £50 by means of any new payment method that becomes available in the future.
6.7 No Prize will be paid on a Ticket that fails THL’s validation process.
6.8 Players will receive their Prize(s) of £250 or less in the Lottery Draw through their Health Lottery online account, where it may be withdrawn. Other Prizes for higher amounts must be claimed by contacting THL on 0330 3902289. Calls to The Health Lottery Helpline will be charged at local call rate.
6.9 Online Players who win a Prize or a combination of Prizes of more than £250 in the Lottery Draw must contact THL on 0330 390 2289 in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.
6.10 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed twice the total value of sales for that draw, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories above £2.50 in proportion so as to bring the total Prize pay-out to a maximum equivalent to twice total sales for that draw or £100,000 (whichever is greater).
6.11 The Prize Pool for each weeks Lottery is calculated once the eligible numbers have been entered into the system. All prizes on the Health Lottery will be paid in full unless Prize Capping is required.
6.12 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.
6.13 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.
6.14 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.
6.15 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen working days of receiving the Player’s identification documents but will not be liable for prize payments that are received beyond the quoted timescale. Prizes for the All Or Nothing Lottery Game must be claimed no later than 18.00 hours on the 180th day following the day of the Draw. Any Prize not claimed within this period will be forfeited. If any Prize is claimed by post, THL must receive the Claim Form at the address shown on the Claim Form within this period.
6.16 Each winning Player is responsible for paying any and all taxes on any Prize won.
6.17 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their consent.
6.18The odds of winning a Prize on The Health Lottery’s All or Nothing lottery draw game is (1 in 4.5). The odds of winning a jackpot is (1 in 2.7M).
7. SELF EXCLUSION
7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.
7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.
7.3 At the end of the Exclusion Term, the player’s account will remain suspended and THL will continue to make no contact with the Player. If a self-excluded Player wishes to return to gambling at the end of the selected term, they must call Customer Support on 0330 3902289 (a local rate call) or email help@healthlottery.co.uk . They will then be required to undertake an interview with our Safer Gambling Team to discuss steps that will be taken to prevent future gambling harm. All returning players will undergo a 24 hour cooling off period during which time they will be unable to access their account. In addition, once the account is active again, they will be monitored by the Safer Gambling Team for at least 3 months. Returning players should also note that if they are unable to provide satisfactory evidence that they are in control of their play, they will be prevented from accessing our games.
7.4 The Player may choose to enter another Exclusion Term at any time.
7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.
7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Customer Support on 0330 390 2289 or email unsubscribe@healthlottery.co.uk. Calls to The Health Lottery Helpline will be charged at local call rate. A Player may also use the unsubscribe link at the bottom of any marketing email to stop any further marketing communications.
7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or by sending a stamped addressed envelope to the address in clause 1.2 above. Alternatively, information is available from www.gamcare.org.uk.
7.8 Players who self-exclude or unsubscribe from marketing should be aware that at the time of opting out, a marketing email or emails may already be scheduled to be sent. As such we may be unable to prevent this from happening. We endeavour to cease all marketing within 24 hours from the point of self-exclusion.
8. LIMITATION OF THE HEALTH LOTTERY’S LIABILITY & RESERVATION OF RIGHTS
8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:
(a) For death or personal injury resulting from THL’s negligence; or
(b) For fraudulent misrepresentation; or
(c) For liability that cannot be excluded or limited by law.
8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:
(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.
(b) Loss of opportunity to enter an All or Nothing Lottery draw and/or right to receive a Prize due to a technical or connectivity failure beyond THL’s control;
(c) Any event which is beyond THL’s or the societies’ reasonable control.
And in addition;
(d) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and
(e) All warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.
8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:
(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;
(b) Any special or indirect or consequential losses; or
(c) Any loss of goodwill or reputation.
8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live transmission will be uninterrupted, timely and / or error-free.
8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.
8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.
8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.
8.8 Online Health Lottery players are responsible for all play on their account; for keeping their login credentials secure, and for taking all necessary steps to ensure that their device/s cannot be accessed by any third-party when they are logged in. The Health Lottery will not be held responsible for any unauthorised game play and subsequent losses due to the account holder’s negligence in this regard.
9. LIABILITY OF PLAYERS
9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.
9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. THL’s Complaints Procedure is available on request by writing to the address in 1.2, by emailing THL at help@healthlottery.co.uk or by calling the Contact Centre on 0330 3902289. 10. COMPLAINTS

11. DISPUTE RESOLUTION
If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator for further investigation and review. This independent adjudicator, namely the Independent Betting Adjudication Service (IBAS), is specialised in the resolution of gaming disputes.

12. INTELLECTUAL PROPERTY
All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.
13. DATA PROTECTION
All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.
14. GOVERNING LAW
These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.
15. INSOLVENCY
We are required by our licence to inform Players about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of insolvency https://www.gamblingcommission.gov.uk/public-and-players/guide/page/information-on-customer-funds-your-money The Lottery monies managed by THL and HLFL on behalf of the CIC are ring-fenced and covered by a Declaration of Trust of which the CIC and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CIC and the Players. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: high protection.
1. INTRODUCTION
1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for The Health Lottery’s QuickWin society lottery draws (QuickWin) which are promoted and managed by Health Lottery ELM Limited (“THL”) on behalf of The Health Lottery Foundation (“the CIC”).

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence number 000-026057-R-309179.
1.4 The Health Lottery Scheme operates under the Gambling Act 2005, (“The Act”).
1.5 The Health Lottery Foundation is licensed by the Gambling Commission to run a society lottery for the benefit of health-related causes within England, Scotland and Wales.
1.6 20% of the proceeds of each Lottery shall go towards health-related Good Causes.
1.7 All entries into and participation in the QuickWin lottery is strictly governed by these T&Cs which are available on The Health Lottery Website. By entering the QuickWin lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the QuickWin lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.
1.8 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules, and THL will provide a copy by post if requested to do so on receipt of a stamped addressed envelope at the address in clause 1.2 above.
1.9 If and when changes are made to the T&Cs, THL will use its database of Players that have registered online to notify all those Players for whom it has email details.
2. DEFINITIONS
Any words within these T&Cs which start with a capital letter shall have the following meanings:
(a) “QuickWin Game” means the online Heath Lottery product with draws held every two and a half minutes (but such frequency may be subject to change). Players choose their own 5 QuickWin numbers between 1 and 50 per line.
(b) “QuickWin Quick Pick Game” means the online Health Lottery product offered by THL with draws normally held every two and a half minutes (but such frequency may be subject to change). In this instance a Player chooses not to select their own QuickWin numbers but instead all numbers are selected at random by the lottery system using a random number generator.
(c) “Bonus Ball” means the number drawn in addition to the 5 regular numbers in the Draw for the QuickWin Lottery. This may also be referred to as the “Bonus Number” in marketing materials referring to the QuickWin Game.
(d) “Claim Form” means a form provided by THL by mail or email to Players claiming a Prize of more than £250 in accordance with the THL postal claim procedure.
(e) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as THL, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the QuickWin Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.
(f) “Fixed Prize” means a prize category below the Jackpot Prize where the winners will receive a set amount of money not shared with other players subject to the same limitations in exceptional circumstances found at sections 6.15 and 6.16 of these T&Cs. These prize categories are a) one free play in the next available draw, b) £1.50, c) £3, d) £10, e) £20, f) £50, g) £250 and h) £10,000.
(g) “Game Rules” means the rules which are applicable to playing the draw-based lottery game (QuickWin Game) and which are published on THL’s website.
(h) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.
(i) “Jackpot” or “Jackpot Prize” means the top prize in any QuickWin Game Lottery Draw.
(j) “Lottery Draw” or “Draw” means the QuickWin Lottery draws conducted by THL every two and a half minutes (but such frequency may be subject to change). THL reserves the right to hold the next available Draw at an alternative time should the Draw in question be subject to a technical error or due to any circumstance beyond the control of Health Lottery Management, at its discretion.
(k) “Lottery Ticket” or “Ticket” means the email confirmation which a Player receives when lines have been purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player (or in the case of a Quick Pick Ticket the numbers selected randomly) for entry into the Lottery Draw and which may contain more than one line of play.
(l) “Play” means any individual selection of 5 numbers per line entered into the QuickWin Lottery.
(m) “Player” means an eligible person who participates in a Draw in accordance with these T&Cs.
(n) “Prize” means the prize monies or free Ticket that may be won in the course of the Draw in accordance with these T&Cs.
(o) “Prize Ticket” means a single Quick Pick entry for Play into a QuickWin lottery Draw issued as a prize for Players who have met the criteria as stated in the terms and conditions.
(p) “Prize Capping” means the process that may be applied, if required by the Gambling Commission to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw of a QuickWin Game exceeds £1m.
(q) “Winning Numbers” or “Regular Number” means the 5 numbers drawn in the QuickWin Game before any Bonus Ball is drawn.
3. CONDITIONS OF ENTRY
3.1 To enter the QuickWin Lottery and to be eligible to win a Prize, Players:
(a) Must be 18 years of age or over; and
(b) Must comply with these T&Cs and any other rules of the QuickWin Lottery notified by THL.
3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the QuickWin Lottery.
3.3 Excluded Persons are ineligible to participate in the QuickWin Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude for a period of 6 months to 5 years. Once excluded, Players will not be able to delete their account as a record of their exclusion must be kept.
3.4 All entry instructions communicated by THL shall form part of the Game Rules of the QuickWin lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.
3.5 20% of the Ticket price will go towards Good Causes.
3.6 By personally accepting the Prize from THL, Players warrant that they:
(a) Are not a director or an employee of THL, the CIC, or a key IT contractor or supplier claiming a prize on their own behalf;
(b) Are not a spouse or dependent of any person described in 3.6(a); and
(c) Are eligible to win a Prize under clause 3.1; and
(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.
3.7 THL will have sole and absolute discretion as to whether to accept any entry to the QuickWin Lottery and pay out any Prizes. Its decision in the matter will be final and binding.
3.8 THL will rely on its own technical logs and records when determining whether a Player is eligible to receive a Prize.
3.9 Special Offer Abuse: If we reasonably suspect that you may deceitfully take (or attempt to take) unfair advantage of, or exploit or manipulate (or attempt to exploit or manipulate), any of the promotions, bonuses or special offers that we may offer on the Site or across our network from time to time (examples of which include: (i) opening multiple indistinguishable accounts to obtain a welcome bonus several times on this Site; (ii) only depositing during promotional periods in order to receive a bonus and not depositing at any other times; (iii) opening multiple accounts on the Site or across our network; (iv) where we have reasonable suspicion as to the truthfulness of your identity; (v) repeatedly depositing, cashing out and redepositing purely to gain a deposit related bonus, then we will deem this to be “Special Offer Abuse”. In such circumstances, we may deny, withhold or withdraw from you any bonus, offer or promotion, either temporarily or permanently, or close your account.
3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter the QuickWin lottery and and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the Website.
4. HOW TO ENTER THE QUICKWIN LOTTERY
4.1 Players enter the QuickWin lottery by using the Website to purchase an online Ticket. Tickets will cost £1 per line per Draw.
4.2 For the QuickWin Game, the Player must choose five different numbers, each of which must be between 1 and 50 inclusive or may prefer to be allocated five different numbers at random in that range (a “Quick Pick”).
4.3 A Ticket will be valid only for the next available Draw as shown on screen. For the avoidance of doubt Players may not pay for forward play beyond the next available Draw.
4.4 In instances where a Player selects their own lottery numbers, it is the Player’s responsibility to check at the time of purchase that the numbers shown on the screen and in the confirmation email are those requested.
4.5 Cancellations are not allowed under any circumstances.
4.6 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.
5. PLAYING THE QUICKWIN LOTTERY
5.1 Online Players of the QuickWin Lottery are required to provide THL with their name, date of birth, address, contact details and bank details before an online registration will be processed. In order to play online Players must have a GB registered debit card registered at a GB address. Identity checks will be carried out to confirm that the Player is at least 18 years old, and this will leave a soft footprint on the Player’s credit file for 12 months.
5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Draws. No more than £500 may be deposited in the e-wallet in a single transaction. Players can make payments by Debit Card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CIC. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.
5.3 No online Player will be permitted to wager more than £75 per day.
5.4 No online Player will be permitted to wager a total of more than £400 per week.
5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.
5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appropriate and will notify the same to Players before the deposit is accepted.
5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termination of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 5 working days.
5.8 Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s marketing database, they should click on the unsubscribe link shown on all THL e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Customer Support on 0330 390 2289.Calls to The Health Lottery Helpline will be charged at local call rate.
5.9 Online entries are final and cannot be cancelled, reversed or refunded once completed.
6. THE QUICKWIN LOTTERY DRAW AND PRIZES
6.1 The results of each QuickWin draw will be published on the Website shall be for information purposes only and a Prize shall only be awarded to a winning Ticket which has the number(s) recorded at the Draw itself. Players will be notified on screen and automatically to their registered e-mail address if they have won a Prize.
6.2 In the Draw, five numbers will be selected at random by an approved Random Number Generator (RNG) from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be selected after all five Winning Numbers have been selected.
6.3 Only one Prize may be claimed in respect of each entry made to the QuickWin lottery Draw.
6.4 Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in a QuickWin lottery Draw will be as follows:
– If the Bonus Ball only is matched on the Player’s Ticket, the Player will win one Prize of a free play in the next available Draw. The free play is fully paid for by THL.
– If one Winning Number and the Bonus Ball are matched on the Player’s Ticket, the Player will win one Prize of £1.50.
– If two of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £3.00.
– If two of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10.00.
– If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £20.00.
– If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.00.
– If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £250.00
– If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.
– If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win a Prize of £25,000.
6.5 Players who win a cash Prize in excess of £10,000 must contact THL on 0330 3902289 or by email at help@healthlottery.co.uk in order to claim their Prize. Calls to The Health Lottery Helpline will be charged at local call rate.
6.6 No Prize will be paid on a Ticket that fails THL’s validation process.
6.7 Online players may collect their Prize(s) of up to £100 in a QuickWin Draw through their Health Lottery online account.
6.8 By claiming and accepting a Prize Players agree to publicity which will be carried out at the sole discretion of THL.
6.9 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £1,000,000, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories in proportion so as to bring the total Prize pay-out to a minimum of £1,000,000.
6.10 THL reserves the right to change the Prize structure without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.
6.11 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.
6.12 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.
6.13 THL will use its reasonable endeavours to provide the Prize payments of £100 and below to the Player within one minute of each Draw. For high prize winners i.e. £10,000 and £25,000 THL will use its reasonable endeavours to provide the Prize payments within fourteen working days of receiving the Player’s identification documents but will not be liable for late delivery. Prizes for the QuickWin Lottery must be claimed no later than 18.00 hours on the 180th day following the day of the Draw. Any Prize not claimed within this period will be forfeited.
6.14 Each winning Player is responsible for paying any and all taxes on any Prize won.
6.15 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their consent.
6.16 Entries not complying with these T&Cs will not be valid.
6.17 The Promoter shall have no liability for any system failure or other action or event which prevents a player from entering the Promotion.

The Health Lottery offers a variety on online scratch cards, each with their own odds of winning, cost per card (or cost per bundle of cards), pay table, jackpot and game rules. The Health Lottery scratchcards listed below are games of chance. This means that the outcome of each card is determined at the point of purchase and players are not able to influence the outcome. The exceptions to this are our interactive scratchcards (such as ‘Elite of Evil’ and ‘Golden Boot’ etc.) which are complex lotteries. This means that a greater part of the outcome is determined at the point of purchase, however there is also a small element of skill involved which can affect the final outcome.
Special Offer Abuse: If we reasonably suspect that you may deceitfully take (or attempt to take) unfair advantage of, or exploit or manipulate (or attempt to exploit or manipulate), any of the promotions, bonuses or special offers that we may offer on the Site or across our network from time to time (examples of which include: (i) opening multiple indistinguishable accounts to obtain a welcome bonus several times on this Site; (ii) only depositing during promotional periods in order to receive a bonus and not depositing at any other times; (iii) opening multiple accounts on the Site or across our network; (iv) where we have reasonable suspicion as to the truthfulness of your identity; (v) repeatedly depositing, cashing out and redepositing purely to gain a deposit related bonus, then we will deem this to be “Special Offer Abuse”. In such circumstances, we may deny, withhold or withdraw from you any bonus, offer or promotion, either temporarily or permanently, or close your account.
Online Health Lottery players are responsible for all play on their account; for keeping their login credentials secure, and for taking all necessary steps to ensure that their device/s cannot be accessed by any third-party when they are logged in. The Health Lottery will not be held responsible for any unauthorised game play and subsequent losses due to the account holder’s negligence in this regard.

1. Definitions
1.1 Definitions
Any words within these Terms and Conditions which start with a capital letter shall have the following meanings:
‘Act’
means the Gambling Act 2005
‘Age Verification Process’
means the automatic process conducted during player registration in order to verify that a player is aged 18 or over.
‘Claim Form’
means the form that will be supplied to a claimant to be completed as part of the process for claiming certain large Prizes in the Lottery Draw Game or Instant Lottery Games.
'Direct Debit'
The entitlement to participate in Draw-Based Games for a multiple number of Draws by setting a recurring payment method. This is currently limited to The Big Win and All or Nothing lottery draw games.
'Entry'
means a chance or entry in a Lottery Draw Game which has been registered as an entry on the Health Lottery Computer System.
‘Excluded Person’
means all persons who do not meet the eligibility criteria set out in clause 4.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, the CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.
‘Game(s)’
means either a Lottery Draw Game or an Instant Win / Scratch Game.
'Health Lottery'
means The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN
‘Health Lottery Computer System’
means the computer system operated by The Health Lottery or its software suppliers for the purpose of recording and entering online entries into a Lottery Draw Game and the purchase and playing of Instant Win / Scratch Games.
‘Instant Win / Scratch Game’
means an instant win scratch game (scratchcard) product offered to Players via the Website.
‘Instant Win / Scratch Game Rules’
means Game Rules published on The Health Lottery website specifically for each Instant Win / Scratch Game product in a ‘Game Rules’ section accompanying each game.
‘Key IT Contractor’
means contractors involved in the development and support of the Health Lottery Computer System software and infrastructure
'Lottery Draw Game'
means The Health Lottery’s draw-based games, namely The Big Win, All Or Nothing and QuickWin.
‘Lottery Draw Game Rules’
means The Health Lottery Draw Game Rules for its Big Win, All or Nothing and QuickWin lottery draw games published on the Health Lottery website.
‘The Big Win Terms and Conditions’
means the Terms and Conditions published separately on the Health Lottery’s website and applying to both retail and online sales of The Big Win Lottery Draw Game.
'Player'
means a member of the playing public who after successfully completing registration and accessing a Game, purchases a ticket, and is eligible to play the Game in accordance the Terms and Conditions relating to this Game.
'Prize'
means a prize listed in the official prize structure of the Game and which has been won by a Player.
‘Self-Excluded Person’
Means any person who has chosen to exclude themselves from the Lottery for any reason, either via the Website, Customer Support or in a Retailer in accordance with the Act.
‘Website’
The website of the Health Lottery at www.healthlottery.co.uk
2. The Health Lottery and the Games
2.1 The Terms and Conditions set out below for playing by remote means of The Health Lottery Draw Games and Instant Win / Scratch Games which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of The Health Lottery Foundation (“the CIC”). With the exception of the current Instant Win / Scratch Games, all the intellectual property rights including copyright and trademarks used on the Health Lottery website are owned by The Health Lottery. The Health Lottery may change these Terms and Conditions from time to time, these changes take effect immediately upon publication to the Health Lottery website and shall be binding on all Players.
2.2 The Big Win Draw Game is played at a retailer, via the Health Lottery Website or by Online Direct Debit, VIP Subscription or recurring debit card and is governed by these Terms and Conditions for Playing the Health Lottery Draw Game and Instant Win / Scratch Games via the Internet and by Direct Debit as well as The Big Win Terms & Conditions and the Game Rules. The Big Win Terms and Conditions and Game rules are published on the Health Lottery website and may be changed from time to time, any changes taking immediate effect upon publication.
2.3 The Health Lottery Instant Win / Scratch Games are governed by these Terms and Conditions. The Health Lottery Instant Win / Scratch Games are also subject to the Instant Win / Scratch Game Rules published on the Health Lottery Website in a ‘Game Rules’ section specific to each Instant Win / Scratch Game.
2.4 The Health Lottery operates society lotteries under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery” or “THL”, depending on the context. Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes.
2.5 The Health Lottery Foundation is licensed by the Gambling Commission to run a society lottery for the benefit of health-related good causes within England, Scotland and Wales.
2.6 A minimum of 20% of the proceeds of each Lottery of the Lottery Draw Game shall go towards health-related good causes.
2.8 For Instant Win / Scratch Games, 20% of the proceeds of every Game shall go towards health-related good causes.
2.9 All entries into and participation in the Games are strictly governed by these Terms and Conditions and the Game Rules. By entering the Lottery Draw Game or an Instant Win / Scratch Game, a Player agrees to be bound by the Terms and Conditions in force on that date. THL reserves the right to refuse any Entry to the Lottery Draw Game and Instant Win / Scratch Games or to withhold any Prize if it has reasonable grounds to believe that the Game Rules & Terms and Conditions have been breached.
2.10 THL reserves the right to amend these Terms and Conditions from time to time. The current version will be posted on the Website, and THL will provide a copy by post on receipt of a stamped address envelope at the address in 1.1.
2.11 These Terms and Conditions apply to all Games played via the Health Lottery Website, or via Direct Debit, VIP Subscription and recurring debit card.
2.12 Only by Registering to Play and accepting the Terms and Conditions, can a Player access Games on the Health Lottery Website or play by Direct Debit, VIP Subscription and recurring debit card.
2.13 The Player warrants that once registered they will play the Game in compliance with the Terms and Conditions and will not use the Health Lottery website for malicious purposes including but not limited to the transmission of offensive content or computer viruses.
2.14 By accepting the Prize from THL, Players warrant that they:
a) are not a director or an employee of THL claiming a prize on their own behalf.
b) an employee of the CIC or a key IT contractor or supplier;
c) are not a spouse or dependent of any person described above in a) and b).
3. The Health Lottery Instant Win / Scratch Games
3.1 The Instant Lottery Games are offered on the Health Lottery’s Website and form part of the Health Lottery scheme, offered through its Remote Operating Licence issued by the Gambling Commission (Licence number 000-026057-R-309179).
3.2 The Health Lottery may at any time announce the opening or the closing of an Instant Lottery Game. The announcement of the closing of a particular Game shall be displayed in the ‘News’ section of the website. This announcement will include the exact closing date and the date and the date by which Prize claims for that particular Game must be received to be valid.
3.3 The Health Lottery may close a Game without notice or compensation should the integrity of the Game be questioned or subject to a complaint by a Player, the Commission or any interested party such as law enforcement agency.
3.4 In order to play any Instant Win / Scratch Game, a Player will need to have completed his account registration in accordance with section 4 below and accepted these Terms and Conditions.
3.5 The result of each Instant Win / Scratch Game shall be pre-determined at the time of purchase and shall not include any element of skill. The Health Lottery Computer System will determine prizes based on the probabilities and not from a limited pool of prizes.
3.6 The chances of winning a Prize will be exactly the same at the point of purchase and shall not be affected by previous wins in the same Game or other Prizes previously paid in other Instant Lottery Games. The advertised prize structure shall remain in place at all times, with each prize tier always available for a win as the Instant Lottery Games do not use a limited pool.
3.7 Prizes for Instant Win / Scratch Games are limited to £25,000, unless the proceeds of a Game shall be greater than £250,000, in which case the prize may be increased to an amount up to £500,000 or 10% of the proceeds, whichever is lower.
3.8 The Game Rules for each Instant Win / Scratch Game shall be contained in a clearly visible ‘Game Rules’ section which shall contain for each game the name of the Game, the price of entry, the play symbols, the Prize structure and the odds of winning for each Prize tier.
3.9 Instant Win / Scratch Games are available on a sample basis in “Play Demo” mode. When the games are played in this mode the player will not be charged to play the game, neither will any prizes displayed be payable. Players will need to complete the Age Verification Process in order to access ‘Play Demo’ mode.
3.10 If a player purchases but fails to complete an Instant Lottery Game for any reason this Instant Lottery Game will be available to resume when the player reconnects to the Health Lottery Computer System.
3.11 An Instant Lottery Game is considered complete when its outcome status in the Health Lottery Computer System shows whether or not a Prize has been won. An Instant Lottery Game is considered incomplete when for any reason it has not been possible, after play has been purchased, to determine whether a Prize has been won or not. Players will have the opportunity to resume an incomplete game upon reconnecting to the Health Lottery Computer System.
3.12 Any Game purchased but not played shall be completed automatically upon closure of this Game, following a notice to players pursuant to section 3.
3.13 If the Health Lottery Computer System shows an Instant Lottery Game as being complete, its result shall stand and the system record of this shall prevail, whether or not the Player has witnessed the completion of the Game.
3.14 The result of all completed Games will be available in the Player’s account history once logged in to the Website.
4. Player Registration
4.1 Registration requirements
(a) Any person wishing to play the Health Lottery online and or set up a direct debit to play must be located in Great Britain. Players and Direct Debit Players agree that playing the Games after registration whilst located in any jurisdiction other than the Great Britain is strictly prohibited. The Health Lottery has the right to terminate a Player's Account and withhold any Prize to any Player or Direct Debit Player in respect of any Games played whilst located in any jurisdiction other than Great Britain.
(b) Any person wishing to play the Health Lottery must be aged 18 years or older;
(c) Any person wishing to play the Health Lottery online must supply their debit card details which must be linked to bank account (or building society) that is based in Great Britain (GB) for which they are an authorised user and must also be linked to a GB address. Players who supply details of a jointly owned bank accept that Prizes won may be paid into that account.
(d) When registering, the bank card referred to in (c) above must not have been reported as lost or stolen and cannot be used to open any more than one Account;
(e) The Health Lottery reserves the right to exclude persons who do not meet the eligibility criteria set out above. Excluded Persons may also include persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, the CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.
4.1.1 The Health Lottery reserves the right to refuse a Registration at its absolute discretion.
4.1.2 The Health Lottery reserves the right to carry out checks or request information from Players during or after registration to verify that the Players and the information supplied by Players meet the criteria set out in this clause. No Prizes will be paid to a Player if the criteria set out in this clause are not met, or if they are ineligible to play for any reason. In carrying out these checks, personal information provided will be disclosed to a credit reference agency to perform an identity check, this is a verification footprint rather than a credit footprint which cannot, under any circumstances be used in the credit decision process or affect the person’s credit rating. The check looks only at the existence of the Name, Address and Date of Birth with lenders rather than any current or previous credit information. This will leave a soft footprint on the Player’s credit file for 12 months. These checks will also be conducted when a postal claim is made and, in the event our electronic checks cannot verify player details, we may request physical documentation such as driving licence or passport to prove eligibility to claim prize. In addition, as part of its ongoing commitment to protecting players from the risk of gambling harm, THL will undertake enhanced due diligence to determine whether a player is spending within their means. THL monitors both financial and behavioural triggers and affordability checks will be carried out on those exhibiting potential signs of harm. These checks will also leave a soft footprint on the Player’s credit file.
4.1.3 In order for The Health Lottery to decide whether the Player is eligible to play, the player will need to provide their name, home address details, date of birth, debit card detail and e-mail address.
4.1.4 Once The Health Lottery has verified the information supplied during the Registration process detailed above you will be asked to enter a Username and Password.
4.1.5 On successful completion of this you will be able to play Games. If The Health Lottery subsequently discovers that a Player was not or is no longer eligible to open an Account, The Health Lottery reserves the right to suspend or terminate that Account.
4.1.6 The Player is responsible for keeping login details secure. You must inform The Health Lottery immediately of any unauthorised access to your Account. Should a player forget their password, the Player must follow the instruction details on the registration or login page in order to obtain a new password.
4.1.7 By completing registration the Player agrees to indemnify the Health Lottery against all costs, damages, claims, liability, expenses, losses and payments incurred by or awarded against The Health Lottery arising directly or indirectly from the Player’s negligent conduct, omission or malicious use of their account.
5. Payment and Funding of Accounts
5.1. Once registered, you will be able to place no more than £500 into your e-wallet at any one time and in any one transaction.
5.2 The Health Lottery will check at the point that you attempt to place money into your account using the debit card details that you supply whether or not you have sufficient funds in your bank (or Building Society) account,
5.3 You will only be permitted to place a maximum of £500 into your wallet at any time or 24-hour period using your Debit Card. You will not be permitted to place any more than £2000 into your online account.
5.4 You will be limited to £80 for any one Lottery Draw Game. You will be limited to £500 worth of play on Instant Win / Scratch Games per day. Players may reduce these limits at their discretion. A reduction we take effect immediately, any subsequent increase requested by the player will be subject to a cooling off period.
5.5 You will only be permitted to withdraw Funds from your online account back onto the Debit Card registered with the Health Lottery. The minimum withdrawal amount is £10 unless your account balance is less than £10 in which case you will be able to withdraw the whole balance.
5.6 Should your debit card be lost, or should you wish to change your registered debit card before it has expired you will be required to contact the Health Lottery’s Customer Support on 0330 390 2289. Before your new card details can be added you will need to withdraw any funds in your account. Should your debit card expire you may update your account with the details of your new card through your account on the website.
5.7 A Player may close an Account at any time, at which time The Health Lottery will return any funds to the bank (or building society) account registered on the Health Lottery Computer system, or by other means should that bank account no longer be active for any reason. Players may close their account online using the 'Close Account' function or alternatively call The Health Lottery Customer Support on 0330 390 2289 to confirm the closure of the account verbally. Players will also have the opportunity to self-exclude from a period of 6 months to 5 years. Self- Excluded Persons who have excluded themselves using a form in a retail point and notified The Health Lottery of their exclusion may be blocked from playing online. THL reserves the right to retain personal details for its own reasonable purposes after an account is closed. Reasons may include, but are not limited to, compliance with anti-money laundering legislation and any other record keeping requirements for legal or regulatory compliance.
5.8 Direct debit cancellations take up to 5 working days to come into effect. If your next payment collection date is scheduled within 5 working days of your notification to cancel, this payment will still be collected, and you will be entered into all draws associated with this payment. If there are more than 5 working days until your next collection date all entries associated with this direct debit will be cancelled and you will not be entered into any subsequent draws.
5.9 Online entries are final and cannot be cancelled, reversed or refunded once completed.
5.10 In addition to these Terms and Conditions, Health Lottery online play is subject to the Terms and Conditions for Playing the Health Lottery Draw Game and Instant Win / Scratch Game via the Internet and by Direct Debit published on The Health Lottery’s website
6. Operation of Accounts
6.1 The Health Lottery may terminate, vary or suspend the provision of the Games, access to a Player's Account’s without prior notice: -
(a) on breach of these Terms and Conditions, the relevant Game Rules; or
(b) for maintenance work required to upgrade or update the Health Lottery Computer System; or
(c) if the Health Lottery ceases to offer the Games; or
(d) for any other reason at the Health Lottery's sole discretion.
6.2 On termination of an Account, the Health Lottery will return the Player's Funds to the bank (or building society) account, details of which are held by the Health Lottery on the Health Lottery Computer System in respect of that Player or return the Funds to the relevant Player by other appropriate means using all reasonable endeavours. In the event that a refund cannot be made the provisions made in Clause 5.3 will apply.
6.3 The Health Lottery’s decisions as to whether or not a Play is a winning Play or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Play, Claim Form, or the payment or awarding of any prize, the Health Lottery may withhold payment of the Prize and/or make an equivalent payment into court until the dispute has been resolved. In the case of Instant Lottery Games only the result held on the THL Computer System will be deemed as the final result. If the images displayed on a player’s screen do not match the record on the Computer System, this will be deemed a display error and the result on the Computer System will stand.
6.4 If a Player informs any bank (or building society) that unauthorised use of a debit card has been undertaken in relation to an Account and the bank (or building society) requests that the relevant sums be returned by the Health Lottery to the relevant Player's bank (or building society) account ("Chargeback"), the Health Lottery will suspend the Player's Account and ask the Player to contact the Customer Support on 0330 3902289.
6.5 The Health Lottery reserves the right to debit the Player's Account with the amount of the Chargeback together with any funds that the Player has utilised that are subject to that Chargeback. If that debit results in a negative balance in the relevant Player's Account, the Health Lottery reserves the right to recover that balance from the Player at which point the Health Lottery will terminate that Account.
6.6 If an Account becomes Dormant and there are funds on that Account, the Health Lottery may at its discretion, return the Funds, to the bank (or building society) supplied by the Player using the debit card details as held by the Health Lottery.
6.7 It is the responsibility of the Player to ensure that the information supplied to register to play the Health Lottery online is kept up to date.

We want you to enjoy playing The Health Lottery; providing excellent customer service is important to us and in the vast majority of cases this is exactly what you will receive. However just occasionally when something goes wrong and a customer, unfortunately has cause to complain.
In the first instance your complaint should be registered with us by calling 0330 3902289* or e-mail us at help@healthlottery.co.uk where a member of our Customer Services team will endeavour to address the issue and resolve the query or if you prefer, you may write to us at the address shown below.

If an immediate solution cannot be achieved because further investigation is necessary, we will let you know straight away.
Should our investigation take longer than anticipated, which will only happen if the circumstances are particularly complex, we will explain why and we will make sure you are provided with regular updates. We will not normally allow any complaint to be unresolved for more than 4 weeks, as we will always agree a course of action with you within this time.
Any investigation will be overseen by a specially selected and trained staff member who will stay in contact with you throughout the investigatory period.
In the unlikely event that you are still unhappy with how your complaint is being handled or resolved, we have in place an escalation procedure which means that you can request the involvement of an appropriate manager by writing to us the addresses show at the bottom.
Complaints must be brought to the attention of The Health Lottery within 180 days of the occurrence in question. In the event that you fail to respond within 90 days to a proposed course of action or a request for further information designed to help resolve your complaint, The Health Lottery will take this to mean that you no longer wish to pursue the complaint. The Health Lottery shall then consider the matter closed.
If at any time you are unhappy with the progress or outcome of our investigations, please do not hesitate to contact the staff member handling your complaint.
If at the end of this process you still remain dissatisfied with the outcome further review can be requested and a full review of the dispute and outcome will be conducted by The Health Lottery Compliance Department.
In the unlikely event you remain dissatisfied with the outcome and subject to your dispute meeting the criteria detailed in the Gambling Commission's Codes of Practice you may request information from the The Health Lottery Compliance Department in relation to the process of referring your complaint to an independent adjudicator for further investigation and review.
The independent adjudicator will consider your complaint totally impartially and we are bound by their decision. The request for third party adjudication information should be made in writing to the address shown below.
